Thank you for entering Nomadesk's "I am a Digital Nomad" contest ("Contest").

Who is involved in running this Contest?
The promoter is Nomadesk, NV, a Belgium corporation with a principal office located at Xavier De Cocklaan 66, PO Box 5, B-9830 Sint-Martens-Latem, Belgium ("Nomadesk"). Instructions and information on how to enter and YouTube's Terms of Use, Community Guidelines and Privacy Policy form part of these conditions of entry ("Conditions of Entry"). By entering the Contest, you agree that these Conditions of Entry apply to your entry and that the decisions of Nomadesk or, where relevant, its Contest partners or the Contest administrator decisions will be final.

Eligibility
This Contest is open only to individuals who are as of October 19, 2009, at least 18 years of age or older. The laws in some places do not allow Nomadesk to run this Contest, in which case the Contest and these Conditions of Entry are void in those places. Also, you cannot enter this Contest if you (or your immediate families or members of your household) are employed by Nomadesk or their subsidiaries and affiliated companies. Professional filmmakers are not permitted to enter. Your entry must be your own new original work, not subject to any third party rights (contractual or otherwise) and must not infringe any third party intellectual property or contractual rights.

To Enter
To enter you must submit a video, at www.youtube.com/group/DigitalNomadContest, in which you share your Digital Nomad story. The maximum length of your entry into a category cannot be greater than 3 minutes. Only one entry per person per category is permitted. To enter you must be a registered user ("Registered User") of the YouTube website (located at www.youtube.com) and a member of the Digital Nomad Contest group. Although there may be more than one person who has been involved in the making or more than one person appearing in the video, ONLY one person will be eligible to win the prizes. Only the person with the Registered User account through which the video is submitted on www.youtube.com/iamadigitalnomad will be eligible to win the prizes. No joint or group entries will be permitted. No payment or purchase of any kind is necessary to enter the Contest, and there is no fee or charge to become a Registered User.

By entering you warrant and represent that your entry conforms to all aspects of the Conditions of Entry and that:
your entry is your own original work;

1. at the time of submitting your entry or any time thereafter, your entry does not contravene any contractual, legal or other obligation;
   
2. at the time of submitting your entry or any time thereafter, your entry does not infringe the intellectual property rights of any third party including, but not limited to, any rights associated with any music contained in your entry;
   
3. you have the relevant permission, where required, to use any third party intellectual property and images or likeness of any person contained in your entry; and
   
4. in producing your video you have complied with all relevant laws, rules and regulations.
   

Contest Schedule
Contest Submission Period: You can enter between 12:00:01 am Central European Time on October 19, 2009 and 11:59:59pm Central European Time on January 31, 2010 ("Contest Submission Period"). Entries must be received during the Contest Submission Period. No responsibility is accepted for late, lost, misdirected or illegible/inaudible entries. This is a game of skill and chance plays no part in determining the winner.

Screening Period: All entries will be screened by the Contest administrator to ensure that entries in the Contest conform to these Conditions of Entry. The Screening Period will occur during the Contest Submission Period and end on January 31, 2010 at 11:59:59pm Central European Time. The Contest administrator reserves the right to invalidate any entry submitted that does not conform to these Conditions of Entry. The Contest administrator's decision is final and binding in all respects.

Community Voting: All eligible entries received during the Contest Submission Period will be posted on YouTube at www.youtube.com/group/DigitalNomadContest, for voting by Registered Users. Community voting will take place between 12:00:01 am Central European Time on October 19, 2009 and 11:59:59pm Central European Time on January 31, 2010 (the "Community Voting Period"). Entrants may not vote for their own entry, and votes are limited to one vote per Registered User. Nomadesk reserves the right to disqualify any entrant who tampers with or influences, or benefits from tampering with or influencing, the entry process or the Contest. The top 10 entries with a combination of the highest ratings and the highest number of recorded Registered User votes during the Community Voting Period will then compete for the grand prize ("Finalists"). The Finalists will be notified via their Registered User account and by posting their names on the Nomadesk website on or before February 5, 2010.

Judging Period: Each Finalists entry will be judged by a panel of judges appointed by Nomadesk. The Judging Period will be conducted between 12:00:01 am Central European Time Zone on February 5, 2010 and 11:59:59pm Central European Time on February 15, 2010. The best valid entry, as determined by the judges, based upon:

1. Originality (where were you working from and why);
   
2. Use of technology (what products aided you in your ability to be productive?); and
   
3. Impact (what were you able to achieve or accomplish?);
   

will then be awarded the grand prize ("Winner"). The judges' decision is final and binding in all respects. The Winner will be notified via their Registered User account on or before February 15, 2010. The winner will be displayed on www.youtube.com/group/DigitalNomadContest and www.nomadesk.com on February 18, 2010.

These prize values are accurate at the start of the Contest, and any change after the Contest begins is beyond Nomadesk's control. Nomadesk is not responsible for any restrictions that may apply for the airline vouchers.

General Conditions
Prizes are not transferable or exchangeable and cannot be taken as cash. Where any of Nomadesk, the Contest partners or the Contest administrator makes a decision in accordance with the Conditions of Entry, such decision is final and binding in all respects. If a prize, or element of a prize, is unavailable for any reason, Nomadesk reserves the right to substitute another prize of equal or greater value for that prize, or element of it, subject to the approval of any relevant authority where required.

Nomadesk accepts no responsibility for any tax implications that may arise from winning the prizes.

The winner is responsible for all insurance and any other expenses, fees and costs connected with the Grand Prize that are not included in the prize description.

Before we can give you your prize, you and your guest will have to sign an eligibility and publicity release (unless prohibited by law), and other agreements as may be required by Nomadesk ("Releases"). These Releases will say that if anything goes wrong with your prize once it's been awarded, you agree that Nomadesk will not be responsible, to the extent permitted by law, and that you consent to use of personally identifying information, including but not limited to your name, city, state, photo, image or likeness for contestal, advertising and publicity purposes without any additional payment to you. If you fail to properly execute and return the Release, you will be disqualified and, at the sole discretion of the Contest administrator, the next highest scoring entrant will be selected to the extent permitted by law.

Except where prohibited, entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by a legal entity in Belgium. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant's rights and obligations, or the rights and obligations of the Nomadesk in connection with the Contest, shall be governed by, and construed in accordance with, the laws Belgium, without giving effect to any choice of law or conflict of law rules (whether of the country of Belgium or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the country of Belgium.

Nomadesk, its Contest partners and Contest administrator will never be liable for any indirect, incidental, special or consequential loss, or loss of profits or revenue arising out of your participation in this Contest. You indemnify Nomadesk, the Contest partners and Contest administrator and any of their associate companies against each claim, action, proceeding, judgment, damage, loss, expense or liability incurred or suffered by, or brought, made or recovered against Nomadesk, the Contest partners and the Contest administrator or their associated companies, including but not limited to:

• any breach of these Conditions of Entry; or
  
• any infringement by you of the intellectual property rights of any third party.
  

Sorry, but this contest is not open to residents of Cuba, Iran, North Korea, Sudan, Myanmar/Burma, Syria and any other U.S. sanctioned country and is void where prohibited by law.

What happens to my entry?
You own your submission according to the terms of your Registered Account. By entering this Contest, you also give Nomadesk a non-exclusive, perpetual, royalty-free, worldwide, irrevocable license to reproduce, publish, adapt, modify, communicate and broadcast all or part of the entry in any form and media, and to sublicense those rights (including to our related companies, licensee publishers and partners). You also consent to us editing, re-using, storing, reproducing and communicating your entry in any medium for any purpose including but not limited to loading it onto any of the Nomadesk web site, online or wireless applications, for use for marketing and publicity purposes and for re-use within any other Nomadesk programs.

Nomadesk, its agencies and companies associated with this Contest will not be liable for:

• any loss (including but not limited to indirect or consequential loss), damage or personal injury which is suffered or sustained (including without limitation to that caused by any person's negligence) relating to this Contest except for any liability which cannot be excluded by law (in which case liability is limited to the minimum amount allowable by law); or
  
• any problems or technical malfunction of any telephone network or lines, computer on-line systems, computer equipment, software, technical problems or traffic congestion on the Internet or at any web site, or any combination thereof, including any injury or damage to participants or any other person's computer related to or resulting from participation in or down-loading any materials in this Contest.
  

Nomadesk may use any personal information you provide in connection with this Contest for the purpose of running the Contest, and also in advertisements, publications, media statements and other contestal material associated with the Contest. Nomadesk may disclose the information for those purposes to its related bodies corporate and contractors. If you do not provide the information requested, you will not be able to enter the contest.
